Please read these Terms of Service (“Terms”, “Terms of Service”) carefully before using the https://sortyourshizzleout.com website/platform (the “Website”/”Platform”) operated by Living Life Being Human, it’s admins or operators and the “Living Life Being Human” Facebook group (“https://www.facebook.com/groups/livinglifebeinghuman”) owned by Facebook Inc. administered by Living Life Being Human, it’s admins or operators, collectively known as “Living Life Being Human” (“Living Life Being Human”,”The Living Life Being Human Platform”, “The Platform”, “us”, “we”, or “our”).

Your access to and use of The Living Life Being Human Platform is conditioned on your acceptance of and compliance with these Terms. These Terms apply to all visitors, users and others who access or use The Platform.

By accessing or using this platform you agree to be bound by these Terms. If you disagree with any part of the terms then you may not access The Platform.

Limited License

Living Life Being Human grants you a non-exclusive, non-transferable, revocable license while you hold an active subscription to access and use our Website in order for you to view and publish content and make purchases of electronic services through our Website, strictly in accordance with our Terms.

Living Life Being Human also grants you non-exclusive, non-transferrable, revocable access while you hold an active subscription to the “Living Life Being Human” Facebook group in order for you to view and publish content according to our Community Guidelines and in accordance with our Terms.

Termination

Access to The Platform is provided on a temporary basis. We may terminate or suspend access to The Platform immediately, without prior notice or liability, for any reason whatsoever, including without limitation if you breach the Terms.

All provisions of the Terms which by their nature should survive termination shall survive termination, including, without limitation, ownership provisions, warranty disclaimers, indemnity and limitations of liability.

Access

We refer to any individual or organisation that use Living Life Being Human as “Members”.

If you register with Living Life Being Human you will be setting up an account with us (“Account”) and may be able to create your own profile. (“Profile”)

We do not guarantee that Living Life Being Human will be available at any particular time or for any particular period of time. From time to time we may restrict access to all or part of the Living Life Being Human Platform with or without notice.

Registration & Security

During registration, you will need to create a unique username and also need to select a password that you can use to access your Account. It is your responsibility for maintaining the confidentiality of your password and user name and are responsible for all activities carried out on your account. We do not have the means to verify the identities of our users and will not be liable where your password or username is used by someone else.

Registration involves signing up for an Account which can take up to 48 hours to process and be approved and administered. This can result in a lag between the time that you subscribe and the time that you have access to The Platform. Once you have signed up and/or paid for a subscription, if you have not received log in details please wait 48 hours before contacting support. At which point if you still don’t have access to The Platform please email jacci@jaccijones.co.uk for assistance.

Pricing

We reserve the right to change the price of any of our Services or Subscriptions at any time without notice. A change in price of any of our services or subscriptions does not affect your own subscription (unless you cancel and wish to re-join).

Cancellations

By placing an order with us for a Service or Subscription you are entering into an ongoing contract with us. You may cancel your contract at any time. To cancel your subscription please email jacci@jaccijones.co.uk.

“Pausing” And Cancelling Subscriptions

For your convenience we allow Subscriptions to be temporarily suspended (“Paused”, “Pausing”) or cancelled outright. Pausing your subscription keeps your account active but temporarily suspends your billing cycle so that you will not be charged until your subscription is resumed. This temporary suspension period may be indefinite but we reserve the right to change this temporary period at any time. If you start using the service again we will automatically resume your subscription payments. You may resume your own subscription at any time. If you choose to cancel your subscription your account will immediately become inactive, you will no longer be billed and any services remaining that would have been rendered within your billing period are forfeit.

We reserve the right to suspend your services as soon as you pause your account and, at our discretion, charge you the full, non-subscription price for any services rendered up until that point.

Refunds

We begin providing our services as soon as you place your order and by placing an order you are requesting that we do so. Your right to cancel and request a refund will only apply to services that have not yet been provided at the time of your request. If you request to begin the performance of services during the cancellation period, you shall pay us an amount in proportion to what has been performed up until you communicated your cancellation from the contract. In other words, we will reimburse to you all payments received in respect of services not yet provided but we are entitled to retain payments or part payments relating to services already provided during the period. We will make any reimbursement using the same method of payment used for the initial transaction.

REFUNDS WILL NOT BE PROVIDED FOR ANY SUBSCRIPTION. WE DO NOT PROVIDE CREDIT, REFUNDS OR PRO-RATED MONTHLY BILLING FOR SUBSCRIPTIONS THAT ARE CANCELLED MID TERM. In such circumstances, you will have access to your subscription until the end of the billing cycle or in the case of yearly billing the end of the month at which point you will receive a pro-rated reimbursement for the remainder of the year unused.

Copyrights and Trademarks

Unless otherwise noted, all materials including without limitation, logos, brand names, images, designs, photographs, video clips and written and other materials that appear as part of our Website are copyrights, trademarks, service marks, trade dress and/or other intellectual property whether registered or unregistered (“Intellectual Property”) owned, controlled or licensed by Living Life Being Human, Training Hub, Jacci Jones Coaching or Parent Plus. Our Website as a whole is protected by copyright and trade dress. Nothing on our Website should be construed as granting, by implication, estoppel or otherwise, any license or right to use any Intellectual Property displayed or used on our Website, without the prior written permission of the Intellectual Property owner. The names and logos of Living Life Being Human, may not be used in any way, including in advertising or publicity pertaining to distribution of materials on our Website, without prior, written permission from Living Life Being Human. Living Life Being Human prohibits the use of any logo of Living Life Being Human or any of its affiliates as part of a link to or from any Website unless Living Life Being Human approves such link in advance and in writing. Fair use of Living Life Being Human’s Intellectual Property requires proper acknowledgment. Other product and company names mentioned in our Website may be the Intellectual Property of their respective owners.

Member Content

By using some of the functions of The Living Life Being Human Platform you may submit to us various content or other material uploaded or submitted by you including content imported from a third party website or otherwise integrated with The Living Life Being Human Platform (“Member Content”). By submitting any Member Content you:

1. agree not to assert against us any moral rights or similar rights in any country in respect of your Member Content and
2. promise us that you own the Member Content and have the right to grant the license set out above and that the Member Content does not infringe on the rights of any third party.

Our Service may contain links to third­ party web sites or services that are not owned or controlled by Living Life Being Human.

Living Life Being Human has no control over, and assumes no responsibility for, the content, privacy policies, or practices of any third party web sites or services. You further acknowledge and agree that Living Life Being Human shall not be responsible or liable, directly or indirectly, for any damage or loss caused or alleged to be caused by or in connection with use of or reliance on any such content, goods or services available on or through any such web sites or services.

Limits On Liability

We do not accept any liability for damage to your computer system or loss of data that results from the use of The Living Life Being Human Platform and we cannot guarantee that any files you download are free from viruses, contamination or other destructive features.

We do not promise that information on The Living Life Being Human Platform is free from errors or omissions. Any decisions or actions taken by you on the basis of any information on The Living Life Being Human Platform are at your sole discretion and risk. We do not promise that The Living Life Being Human Platform will be available uninterrupted and in a fully operating condition. Access to The Living Life Being Human Platform may be suspended temporarily and without notice.

We are under no obligation to keep secure or to store any Member Content for any period of time and shall have no liability to you for any damage, loss, liability, cost or expense incurred by you as a result of the loss or deletion of any Member Content. You are solely responsible for creating any back-up copies of any Member Content.

All communications and interactions between Members are matters between them and we are not responsible for the actions of any Members or third parties. Living Life Being Human, it’s admins and operators will not be held personally or professionally liable for the actions or words of any Members of The Living Life Being Human Platform.

We do not make any promise to you in relation to the suitability (or any other attributes) of other Members or their activities, products and services.

In these Terms, any phrase that includes the words “other”, “including”, “for example”, “such as” or “in particular” (or any similar expressions) shall be deemed to include the phrase “without limitation”.

Changes

We reserve the right, at our sole discretion, to modify or replace these Terms at any time. If a revision is material we will try to provide at least 30 days notice prior to any new terms taking effect. What constitutes a material change will be determined at our sole discretion.

By continuing to access or use our Service after those revisions become effective, you agree to be bound by the revised terms. If you do not agree to the new terms, please stop using the Service.

Governing Law

These Terms shall be governed and construed in accordance with the laws of The United Kingdom, without regard to its conflict of law provisions. In the event of any dispute between you and us concerning these Terms, the relevant United Kingdom law will apply. If you wish to take court proceedings against us you must do so within the relevant United Kingdom courts.

Our failure to enforce any right or provision of these Terms will not be considered a waiver of those rights. If any provision of these Terms is held to be invalid or unenforceable by a court, the remaining provisions of these Terms will remain in effect. These Terms constitute the entire agreement between us regarding our Service, and supersede and replace any prior agreements we might have between us regarding the Service.
